Terms of Service

1. Acceptance
By accessing holam.co or purchasing any holam service, you agree to these Terms of Service. If you do not agree, do not use our services.
2. Services
holam provides managed AI operations services including AI Voice Receptionist, AI SDR, AI Customer Support, and AI Document Processor. Specific terms for each service are set out in your service agreement.
3. Outcome guarantee
Growth and Scale tier clients are entitled to a monthly fee waiver for any month in which holam fails to meet the stated outcome floor. This guarantee does not apply to force-majeure events, third-party platform outages, or failure caused by client-provided data or integrations.
4. 14-day money-back guarantee
If, within the first 14 days of your live service, the system does not operate correctly or is not trained to a satisfactory standard, you may request a full refund of the first month's fee via email to hello@holam.co. Refunds are processed within 10 business days.
5. Payment
Services are billed monthly in advance. Setup fees (where applicable) are due on signing. Annual prepayment receives two months free. Overdue invoices may result in service suspension.
6. Intellectual property
holam retains ownership of all AI models, systems, and infrastructure. Client retains ownership of their data, brand assets, and business information provided to holam.
7. Confidentiality
Both parties agree to keep confidential any non-public information received from the other party. This obligation survives termination of the service agreement.
8. Limitation of liability
holam's total liability for any claim arising out of or related to these terms shall not exceed the fees paid by the client in the three months preceding the claim. holam is not liable for indirect, incidental, or consequential damages.
9. Termination
Either party may terminate month-to-month services with 30 days' written notice. Annual contracts may be terminated for cause with immediate effect.
10. Governing law
These terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved by binding arbitration under AAA rules.
11. Changes
We may update these terms. Material changes will be communicated via email with 30 days' notice. Continued use of the service after the notice period constitutes acceptance.
